Terms & Conditions of Service

1. Artistic Discretion & Style Consistency

By commissioning Max Fomin (“The Photographer”), the Client acknowledges and agrees to the following:

  • Aesthetic Alignment: The Client has reviewed the Photographer’s portfolio and website and chooses to book based on the established documentary, unscripted, and film-inspired aesthetic.
  • Creative Control: The Photographer reserves full artistic control over the choice of shots, lighting, and composition. No specific shot is guaranteed, as the work is documentary in nature.
  • Editing Style: The Photographer’s editing style is final. This includes specific color grading and textures. The Client agrees that no re-editing, clean versions, or RAW (unprocessed) files will be provided under any circumstances.
  • Retouching: Standard editing includes color correction and exposure adjustments. Heavy retouching—such as body modification, physical alterations, or complex object removal—is not included in any package.

2. Professional Workflow & Timeline

  • The Process: The Client agrees to the workflow outlined in the Welcome Guide.
  • Delivery Turnaround: While the Photographer strives for the fastest possible delivery (typically 48-hour previews and 5–10 business days for full galleries), these timelines are estimates and not a guarantee.
  • Client Cooperation: For Hospitality and Spaces, the Client is responsible for ensuring the space is shoot-ready. The Photographer is not responsible for cleaning, staging, or moving furniture.

3. Payments, Retainers & Pricing

  • Non-Refundable Retainer: To secure a date, a non-refundable retainer is required. This fee covers the administrative cost of booking and the loss of potential income from other clients for that date.
  • Price Protection: All baseline rates are set for a current time. Any project rescheduled may be subject to updated pricing.
  • Final Payment: Failure to complete final payment by the due date may result in the immediate cancellation of the shoot or a delay in gallery delivery.

4. Intellectual Property & Usage Rights

  • Ownership: The Photographer remains the sole owner of the copyright for all images produced unless otherwise agreed before the photoshoot happened. 
  • Hospitality/Commercial License: Clients are granted a non-exclusive license for digital and print marketing. This license is for the Client only; it does not extend to third-party vendors (architects, designers, or contractors) without prior written consent and potential additional licensing fees.
  • Portfolio Use: The Photographer may use any images for self-promotion, website portfolios, and social media. If the Client requires a Non-Disclosure or private shoot, this must be negotiated and paid for as a separate fee prior to the shoot.

5. Limitation of Liability & Force Majeure

  • Technical Failure: In the highly unlikely event of total equipment failure or loss of digital data, the Photographer’s liability is limited strictly to a full refund of all monies paid.
  • Force Majeure: The Photographer is not liable for failure to perform due to circumstances beyond their control (e.g., extreme weather, venue closures, illness, or government restrictions).
  • Third-Party interference: The Photographer is not responsible for compromised shots caused by guests, other vendors, or physical obstructions at the location.

6. Cancellation & Rescheduling

  • Client Cancellation: If a Client cancels, the retainer is forfeited.
  • Rescheduling: One reschedule is permitted if requested at least 14 days in advance (Portraits/Hospitality) or 90 days (Weddings), subject to the Photographer’s availability. Subsequent reschedules will require a new retainer fee.
